It’s called a “trade-dress” infringement, not a “trade-mark” infringement.
Mariano is a nickname for Mario in Spanish speaking countries.
A nickname only slightly different yet longer huh? Those Spanish are crafty.
Mario and Mariano are both used spanish names. No nickname relationship between them.
