Any newspaper editor could use this picture as a sports/lifestyle picture and it would be fine. The same applies to Internet publication.
However, the minute Failblog put that “Chester” heading on it, it became actionable in law because it carried the direct implication that the referee was a pedophile. I can tell you, as a media lawyer, that he would have walked all over Failblog had he chosen to.
The test in libel law, which applies online just as readily as in print or broadcast, is whether or not “a jury of fair-minded individuals would consider that the reputation and standing of the individual had been damaged in the eyes of his peers”. You might or might not decide that being labelled a pedo is damaging. I know what I think. Whether or not some of you thought it was funny is irrelevant as far as the law of libel is concerned.

I personally found this hilarious. I wrestled in high school for 3 years, and you dont understand how many wrestling jokes there are. Its just funny, the guy has an awkward look on his face, nothing more, nothing less. I had plenty of awkward wrestling pics in awkward poses. And I look at them and laugh, because its awkward. Nothing more, nothing less. Dont get all butt hurt about it, there are literally thousands of pictures on this site that are a lot worse, have a sense of humor or move on.
