Similar story: Our company boss received a cease and desist letter for using a twitter account with a city name. They want to sue him for using Twitter!

Failblog – what do you guys recommend? Guinness sent you a similar letter and threatened you regarding what you’re doing. We’re a small company and don’t want to let these big government guys walk all over us because we use social media and the Internet.

I would like to point out the Case of Gyles v Wilcox and the Copyright Act of 1976, 17 U.S.C. § 107.
That section states,
Notwithstanding the provisions of sections 17 U.S.C. § 106 and 17 U.S.C. § 106A, the fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright. In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include:
1. the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes;
2. the nature of the copyrighted work;
3. the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and
4. the effect of the use upon the potential market for or value of the copyrighted work.
The fact that a work is unpublished shall not itself bar a finding of fair use if such finding is made upon consideration of all the above factors.

Well Obviously Failblog is not making money using their logo and the use of the logo is only providing validation of their company being the owner of said page as well as the link being shown (or was) in the screen shot pointing to their site.

Failblog is obviously NOT saying it IS Guinness only referencing it in this screen shot. Hence Fair Use applies. I think Failblog should restore the original image and tell Guinness where to stick it.

The original, the screen cap does fall under Fair Use. Plain and Simple, you can remove the edit on the logo.

Here is your legal Fair Use Defense for use of the unedited screen cap:

1. GBWR logo is too small the screen cap and does not represent confusion between GBWR and Failblog. It doesn’t force GBWR’s copyright to loose value, since the fail was in their error.

2. It’s Criticism of GBWR for being such a fail.

3. It’s news that GBWR can have such an epic fail and failblog is a specialty is reporting this source of news.

The GBWR legal team is just being a bully, they may be able to take you to court, but any judge in their right mind would throw it out. They are simply embarrassed that they were appearing to promote Terrorism.

This is not a legal document, I am not a lawyer. This is just an opinion from some one who has been the “Fair Use” grinder with several major corporations and won every time. Here is a Video on Fair Use, using cartoon characters from major motion pictures.
