Well I'm a Health Inspector in California. I can't speak for the other states, as some laws differ from state to state, however it is absolutely NOT illegal to sell expired food products in California. We could discuss the finer points of 'use by' and 'best before' but it wouldn't change anything in regards to the law. In fact there are facilities called food salvagers that specialize in such foods and sell them at a steep discount. Even dairy products are sold there, although I probably wouldn't buy expired dairy foods. (Of course the dairy industry cares more about spoilage bacteria than anything that would actually make you sick, but that's another story.) Many regular grocery stores removed expired products just because they know their customers will complain. Regardless, there is nothing that even says you cannot sell expired baby food, although where I work, it is common practice amongst the health inspectors to require vendors to discard expired baby products. As long as the labels are intact, there are no signs of bugs inside, and the package appears unadulterated and undamaged, just use common sense as to whether something seems safe to eat or not. Of course never use canned products if they seem swollen or the seams are rusty, and never use a jarred product if the vacuum seal isn't intact. The food industry went for decades before dates were required on packages and I don't think too many people ended up suffering over it. I agree with the person up above, I hate seeing the food wasted when people are going hungry. I have often driven through the countryside in Ag areas and seen whole fields covered with produce that the automatic harvesting machines left behind. You could live very well on such 'leftovers' if you knew where to go. I wonder if anyone is still bothering to read this thread? lol!

Just like "Trollike" said above, it's not *illegal* to sell past-date food in the US except for dairy and meat, and even that's not illegal, it just tends to be really gross. Food Banks (like where I work) get dates from most food manufacturers near or past which their food products can still be safely consumed. For example, most cereals are edible up to a year after their "best by" date - maybe a little stale at 3 or 6 months, but still nutritious as long as it's been stored properly. Things that are packed with salt and preservatives - dry or canned - can be stored almost indefinitely. The things to watch for in canned foods are more acidic things - tomato products especially - they tend to spoil more quickly.

"When in doubt, throw it out," but if you use your nose and common sense, and there'd be a hell of a lot less waste of food and money in the US.

In Estonia (European Union), we have a difference between "best before" and "use by". If a food item is labelled "best before", then it is still edible, even though perhaps not the best any more, and it can be sold in the store if it is marked properly - for example, cereals, pasta, candies etc. If it, on the other hand, bears marking "use by" (e.g. dairy and meat products), then it is not allowed to be sold after the date on the package.

I'm quite sure it is an EU regulation or something.

eh, J's loss is the gain of every person with a brain in their head who shops thrift stores first before they look for something new. As long as all the people who get rid of their things after its been used once donate it to a thrift store/sale we don't have a problem. let the idiots pay premium prices for designer labels, wear them once and then throw it in the donation box. Ill buy it for $1. AND NOONE BUT ME WILL EVER KNOW. New to me is just as good as new, only cheaper.

so ? you think the thing you pay extra to get new has never been worn? Let me ask you...did you try it on before you bought it? Do you think stores dryclean everything that has been tried on in the store? Unless you make it yourself, its been worn by someone else. thats why you CLEAN it.

Maybe because some people value savings more than their ego?
Maybe because they know it's secondhand, but nobody else does?
If it's not stained or totally worn out, it's no different than if you had owned it the whole time... you must throw your clothes out after you wear them 2 or 3 times, right?

I once ate a luncheon meat can 10 years past the date, the can was normal, there was no sound when opening, the meat smelled really tasty and was not discolored or something. The can was kept in the basement at around +4 degrees, "cool dry place". It was delicious.

Dude, prostitutes past menopause don't need any signs on them, if you don't see a difference, you probably wouldn't get much use of a past-menopause prostitute.

Bo, which country or (if US) state do you live in? In the US, in most states, it is not illegal to sell expired food...specifically because it isn't expired. Most stores interpret the "sell by" date as being the expiry date, which it is not. In fact, many foods are good for YEARS after the "expiry", especially dried goods.

i so totally agree! And shopping at thrifts often benefits charities. I regularly shop the local Goodwills and other thrift stores because you just never know what you might find. i get a lot of my ren faire feast ware from there as well. Once i found a set of 4 period pewter plates, the good ones, not the knockoffs, for like 50 cents a plate. If i had bought them new i would have had to pay about $15-20 a plate.
